NOTIFY Terms and Conditions
_Terms governing the NOTIFY smart reminder and alert platform_
1. Agreement to These Terms
These Terms and Conditions ("Terms") govern your access to and use of
NOTIFY. By creating an account, purchasing a service or using NOTIFY,
you agree to these Terms and acknowledge the NOTIFY Privacy Policy. If
you do not agree, you should not use the service.
2. About NOTIFY
NOTIFY is a smart reminder and alert platform that helps individuals and
professionals keep track of important dates, tasks, deadlines and
commitments. Depending on the services available to you, reminders may
be delivered by SMS, email, app notification or another supported
channel.
NOTIFY may be used for matters such as vehicle insurance and technical
inspection renewals, medical appointments and medication schedules,
flight and travel reminders, passport and visa expiry dates, project
deadlines, contract renewals, bills, rent payments and personal or
family events.
3. The Core Nature of the Service
NOTIFY helps you remember. The underlying obligation remains yours.
NOTIFY is a reminder and notification service. Unless we expressly state
otherwise for a specific feature, we do not renew your insurance, pay
your bills, extend your passport or visa, change your flight, file
documents, attend appointments, take medication on your behalf, or
complete the task identified in a reminder.
4. Eligibility and Accounts
- You must provide accurate and current registration and contact
information.
- You are responsible for maintaining the confidentiality of your
password, PIN and verification codes.
- You must promptly update your mobile number or email address when it
changes.
- You must not impersonate another person or create an account using
information you are not authorized to use.
- Where a person under 18 uses a feature requiring parental or
legal-representative authorization, that authorization must be
provided as required by law.
5. Creating and Managing Reminders
You control the information used to create your reminders. You are
responsible for checking that dates, times, recurrence settings, contact
details and reminder content are correct. You should update or cancel a
reminder if the underlying event or obligation changes.
A reminder displayed as scheduled does not confirm that the underlying
date, obligation, document, booking or requirement remains valid. Where
accuracy matters, verify it with the relevant official source or service
provider.
6. Delivery of Notifications
NOTIFY will use reasonable efforts to deliver notifications according to
the settings and service level selected by the user. Delivery may be
affected by mobile-network congestion, internet outages, email
filtering, device settings, unavailable devices, incorrect contact
information, third-party provider failures, force majeure or other
circumstances beyond NOTIFY's reasonable control.
You should not rely on a single NOTIFY reminder as the only safeguard
for a legally, financially, medically or otherwise critical deadline.
Where appropriate, maintain the original document, appointment
information or official calendar as a backup.
7. Vehicle and Document Renewal Reminders
Vehicle insurance, technical inspection and similar reminders are
organizational tools. NOTIFY does not itself determine whether a
vehicle, policy, certificate, licence or other document is legally valid
unless a specific verification service expressly states that it does.
Users remain responsible for verifying applicable renewal requirements
and completing renewals with the competent provider or authority.
8. Medical and Medication Reminders
NOTIFY may remind users about medical appointments or medication
schedules that they or an authorized person enter. NOTIFY is not a
hospital, pharmacy or healthcare professional and does not diagnose,
prescribe, determine dosage or replace medical advice.
Medication instructions should come from a qualified healthcare
professional or authorized medicine label. In an emergency or where
urgent medical attention may be required, seek appropriate medical care
rather than relying on NOTIFY.
9. Travel, Flight, Passport and Visa Reminders
Travel reminders are organizational tools. Unless a feature expressly
provides verified real-time information, NOTIFY does not guarantee
airline schedules, immigration rules, visa requirements, passport
validity requirements, border-entry eligibility or government processing
times. Users remain responsible for confirming current requirements with
the relevant airline, embassy, consulate, immigration authority or other
official source.
10. Professional, Contract and Payment-Deadline Reminders
NOTIFY may be used to track projects, contracts, rent, bills and other
deadlines. A reminder does not constitute legal, financial, accounting
or professional advice and does not modify the terms of a contract,
invoice, lease or other obligation. Users are responsible for verifying
and complying with the underlying obligation.
11. User Responsibilities
- Check that reminder dates, times, descriptions and contact details are
accurate.
- Keep your account and device reasonably secure.
- Act on reminders where action is required. NOTIFY cannot complete the
underlying task for you unless a specific feature expressly provides
that service.
- Verify critical legal, medical, financial, immigration, travel or
contractual information with an appropriate authoritative source.
- Use NOTIFY only for lawful purposes and respect the privacy and rights
of others.
12. Prohibited Uses
- Using NOTIFY for fraud, harassment, threats, spam or unlawful
communications.
- Attempting unauthorized access to accounts, systems or data.
- Introducing malware, disrupting the service or bypassing security
controls.
- Scraping or extracting data at scale without authorization.
- Using another person's personal or sensitive information without a
lawful basis or authority.
- Using NOTIFY in a manner that violates applicable law or another
person's intellectual-property, privacy or other rights.
13. Language
NOTIFY may provide services and communications in English, French and
other languages introduced from time to time. Translations are intended
to improve accessibility. Where a discrepancy arises in legal terms, the
version designated by NOTIFY as controlling will apply to the extent
permitted by law.
14. Fees and Paid Services
Some NOTIFY features may be free and others may require a subscription,
one-time fee or other payment. Prices, billing periods and material
payment conditions will be shown before purchase. Applicable taxes or
telecommunications charges may be added where required.
NOTIFY may use supported payment channels such as MTN Mobile Money,
Orange Money, Visa or other payment providers. A payment provider may
impose its own terms, verification requirements and charges.
15. Recurring Subscriptions
Where a subscription renews automatically, the renewal frequency, price
and cancellation method will be disclosed before the user subscribes.
Where legally required, NOTIFY will obtain the user's authorization for
recurring charges and provide required renewal notices. Users may cancel
future renewals using the method provided in the service, subject to the
applicable plan terms.
16. Failed Payments, Cancellation and Refunds
If a payment fails, access to a paid feature may be limited or suspended
after appropriate notice. Cancellation stops future service or renewal
as described at the time of purchase.
Refund eligibility depends on the service purchased, whether the service
has already been supplied and any mandatory rights under applicable
consumer law. NOTIFY will not contract out of refund or cancellation
rights that cannot lawfully be excluded.
17. Telecommunications and Data Charges
Your mobile operator or internet provider may charge for SMS, calls,
mobile data or other connectivity. Unless expressly included in a NOTIFY
plan, those third-party charges are your responsibility.
18. Intellectual Property
The NOTIFY name, logo, software, interface, original content, designs,
databases and other intellectual property are owned by or licensed to
NOTIFY. Subject to these Terms, NOTIFY grants you a limited, personal,
non-exclusive, non-transferable and revocable licence to use the service
for its intended purpose.
You may not copy, sell, sublicense, reverse engineer, reproduce or
commercially exploit NOTIFY's protected materials except where
expressly permitted by law or written authorization.
19. Your Content
You retain ownership of information you lawfully enter into NOTIFY. You
grant NOTIFY the limited rights necessary to host, process, transmit,
back up and display that information for the purpose of operating and
securing the service. You must have the right to provide any information
concerning another person.
20. Privacy
Our collection and use of personal data is governed by the NOTIFY
Privacy Policy. The Privacy Policy forms an important part of the rules
governing the service and should be read together with these Terms.
21. Third-Party Services
NOTIFY may depend on third-party telecommunications, cloud, email,
payment, authentication or other providers. Their services may be
governed by separate terms. NOTIFY remains responsible for its own
obligations but cannot guarantee the uninterrupted operation of
independent third-party networks or services.
22. Service Availability, Maintenance and Changes
We may update, maintain or change NOTIFY to improve security,
reliability, functionality or compliance. Temporary interruptions may
occur. Where a material change significantly affects a paid service, we
will provide notice where reasonably practicable or legally required.
23. Suspension and Termination
We may suspend or restrict an account where reasonably necessary to
investigate fraud or abuse, address a security risk, protect other
users, comply with law, respond to non-payment or enforce these Terms.
Where appropriate, we will provide notice and an opportunity to resolve
the issue.
You may stop using NOTIFY and request account closure at any time,
subject to outstanding obligations and lawful data-retention
requirements.
24. Disclaimers
NOTIFY is designed to reduce the risk of forgetting, not to guarantee
that a user will never miss a deadline or obligation. To the extent
permitted by law, the service is provided on an "as available" basis
and may occasionally experience delays or interruptions.
Nothing in these Terms excludes statutory warranties, consumer
protections or other rights that cannot lawfully be excluded.
25. Limitation of Liability
To the extent permitted by applicable law, NOTIFY will not be
responsible for losses caused solely by incorrect information entered by
a user, a user's failure to update changed information, a user's
failure to act on a delivered reminder, or failures of independent
telecommunications or other third-party systems outside NOTIFY's
reasonable control.
NOTIFY does not exclude or limit liability where doing so is prohibited
by law. Any final monetary liability cap applicable to paid services
should be established in the published version after legal review and in
accordance with applicable consumer law.
26. Indemnity for Misuse
To the extent permitted by law, you are responsible for losses or claims
arising from your unlawful use of NOTIFY, violation of another person's
rights, or information you submit without authority. This provision does
not require a consumer to indemnify NOTIFY for NOTIFY's own unlawful
conduct.
27. Changes to These Terms
We may update these Terms to reflect changes to the service, business
model or applicable law. Material changes will be communicated through
an appropriate channel. Where required, we will seek renewed acceptance
before the changes apply.
28. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of Cameroon, except
where mandatory law provides otherwise. If a dispute arises, the parties
should first attempt to resolve it in good faith through NOTIFY's
customer-support or legal contact.
The final forum, jurisdiction and any mediation or arbitration mechanism
should be confirmed with Cameroonian legal counsel before these Terms
are published. Nothing in these Terms removes a consumer's right to use
a competent authority or court where that right cannot lawfully be
restricted.
